Driver challenges garda evidence
A KILANERIN man who challenged the exact location where Gardaí found him and his car had his case adjourned until April at last week's sitting of Arklow District Court.
Kevin Twomey (43), Burley, Kilanerin, was charged with being drunk in charge at Curranstown Upper, Arklow, on November 29, 2009.
Garda Darragh McEvoy said at 12.15 am he was on patrol in Curranstown Upper and saw a green Seat car stopped at the side of the road. The lights were on and the engine was running. Twomey was sitting in the driver's seat and he was slumped against the window.
Garda McEvoy said he roused Twomey and spoke to him. He was arrested shortly afterwards and brought to Wicklow Garda Station where he was found to have a breath alcohol concentration of 61mg of alcohol per 100ml of breath.
In his own evidence, Twomey said he was parked in front of a residential house and the owner had since told him the address was Cooladangan. He said Curranstown Upper was some distance away.
Judge Murrough Connellan adjourned the case until April 14 to allow evidence of the exact area to be heard.
